E4.1  ENVIRONMENT IMPACT ASSESSMENT (EIA)

Pursuant to the Act No. 100/2001 Code, on environment impact assessment and amending certain related acts (hereinafter as the Act) plans of activities (projects EIA) and concepts of activities (strategic EIA), which implementation could seriously affect the environment, are subject to environment impact assessment procedure pursuant to this Act.

In 2009 the Department of the Environment of the Prague City Hall (OOP MHMP), as the competent authority, received eighty-one notifications requiring preliminary proceedings pursuant to the Act. In 2009 nine EIA processes were terminated, on the basis of preliminary proceedings, concluding the activities should be further assessed pursuant to the Act, and sixty-nine plans should not be further assessed. In the period six decisions were issued pursuant to Section 10 of the Act, nine EIA processes were cancelled upon the request of their respective investors, and one process was handed over for the completion of preliminary proceedings to the Ministry of the Environment.

Since the Act No. 100/2001 Code became effective, that is from 1 January 2002 to 31 December 2009, the OOP MHMP received 690 notifications in total over the whole period 2002–2009.

Out of the plans being subject to preliminary proceedings the majority was of plans in sense of point 10.6 category II of the Annex No. 1 (warehouse or commercial premises, including shopping centres, parkings, or garages), that means various multifunction premises where there are administrative, cultural, sports, etc. functions, besides trade function.

Since the amendment to the Act became effective (that is from 22 August 2007 to 31 December 2009) the OOP MHMP received in total 882 EIA notifications of activities with details pursuant Annex No. 3a that were below limits. Out of them 365 notifications were submitted in 2009. In case of 373 notifications communication was released in 2009 that the activity is not subject of preliminary proceedings and in case of five notifications that the activity is subject of preliminary proceedings.

In 2009 the Ministry of the Environment (MOE), as the competent authority received six notifications of activities on the territory of the City of Prague and one process delegated from the Prague City Hall for the completion thereof. In the period monitored three processes were concluded that the activity concerned shall not be further assessed pursuant to the Act, and four processes that the activity concerned shall be further assessed. Two decisions were issued pursuant to Section 10 of the Act. In the period 2002–2009 the MOE received in total forty-nine EIA notifications of activities affecting the territory of the City of Prague.

In the period monitored the Regional Authority of the Central Bohemia Region (CBB), as the competent authority, has received two notifications on a project plan, which would affect the Prague’s territory. Two EIA processes were concluded that the plans should not be further assessed pursuant to the Act. One decision was issued. In the period 2002–2009 the Regional Authority CBB was dealing with in total ten activities being subject to the preliminary proceedings decision and affecting the territory of the City of Prague.

E4.2  INTEGRATED POLLUTION PREVENTION AND CONTROL (IPPC)

The Act on Integrated Pollution Prevention and Control – IPPC forms the cornerstone of the Czech environmental legislation harmonisation with that of the European Union.

The Act No. 76/2002 Code on integrated pollution prevention and control, on the Integrated Pollution Register, and amending certain acts (Act on Integrated Pollution Prevention and Control) became effective on 1 January 2003. At the same time executive regulations to the Act were adopted.

Since the Act became valid (2003) till the end of 2009 there have been thirty-one valid integrated permits and eighty-four changes to such permits on the territory of the City of Prague. Three permits of them were dismissed due to the termination of operations. Therefore there were twenty-eight facilities having integrated permit issued in Prague by the end of 2009.
